In December 19th, the EU officially announced an amendment to the new method of anti-dumping investigation. The Ministry of Commerce spokesman made a talk about it.

The spokesman said that China has been paying close attention to the new EU anti-dumping investigation method of amending the law process, many times to the EU expressed concern to china. We note that for the performance of China joined WTO obligations protocol under Clause fifteenth, the EU anti-dumping legal method of the new amendment to abolish the "non market economy countries, the EU anti-dumping legal list" will no longer have to Chinese as a "non market economy" legal hypothesis. At the same time, the European Union introduced the concept of "serious distortion". When the so-called market is seriously distorted, the EU can abandon the price or cost of the exporting country, and choose the third country or the international market price or cost to decide whether there is dumping. The Chinese side believes that this method is in violation of the WTO rules.

The spokesman pointed out that there is no "serious distortion" concept in the WTO rules, nor the provisions of social and environmental dumping. The new method of EU anti-dumping investigation lacks the basis of WTO rules. The EU will continue to use the "alternative country approach" to break through the WTO rules, and it will weaken the authority of WTO's anti-dumping law system by measuring the "serious distortion" of other countries by the EU's unilateral standards.

The spokesman stressed that the European Union as an important member of the WTO should respect international rules. Only by maintaining the authority of the multilateral trading system can it benefit the common interests of all countries. China urged the EU to strictly abide by the rules of the WTO, in good faith, fully fulfill its international treaty obligations. China reserves the relevant rights under the WTO dispute settlement mechanism and will take the necessary measures to safeguard the legitimate rights and interests of the Chinese side.
